1.- Titularidad de la página web
Famaztella S.L., con domicilio en Madrid, Alberto Alcocer nº 13 – 7º Izda, es la titular de la página web http://www.jmaznar.es (en lo sucesivo, la web) y la pone a disposición de los usuarios de Internet, con el fin de proporcionar información sobre la figura de José María Aznar.
2.- Condiciones Generales de Utilización y Aceptación de las mismas
Las presentes condiciones generales de utilización de la web tienen por finalidad la regulación e información a los usuarios del uso de la web.
La navegación y la utilización de los servicios de la web suponen la aceptación como Usuario y sin reservas de ningún tipo, de todas las condiciones generales de utilización, de las condiciones generales de contratación si las hubiese y cualesquiera otras que puedan existir en relación con José María Aznar.
Famaztella S.L. podrá en todo momento y sin previo aviso, modificar las presentes condiciones generales, así como las condiciones generales de contratación en su caso y las condiciones generales que se incluyan mediante la publicación de las citadas modificaciones en la web a fin de que sean conocidas con carácter previo por los usuarios. Cualquier cambio que se produzca en éstas será comunicado en la página principal de la web durante un plazo que se entienda razonable.
3.- Política de Protección de Datos de Carácter Personal
En cumplimiento de lo dispuesto en la Ley Orgánica 15/1999, de 13 de diciembre de Protección de Datos de Carácter Personal, Famaztella S.L. informa al Usuario de la existencia de un fichero de datos de carácter personal creado con los datos obtenidos en la página web por y para Famaztella S.L. y bajo su responsabilidad, fichero que ha sido debidamente comunicado al Registro General de la Agencia de Protección de Datos.
Dicho fichero ha sido creado con la finalidad de facilitar información sobre José María Aznar, así como la realización de actividades promocionales y publicitarias vinculadas con él mediante cualquier medio, incluyendo el envío de correos electrónicos para lo cual se recabará el consentimiento expreso del Usuario.
3.1.- Consentimiento del Usuario: El Usuario acepta la inclusión de los datos recabados durante la navegación por el Portal, o proporcionados mediante la cumplimentación de cualquier formulario que en él se encuentre así como los derivados de las eventuales relaciones comerciales que puedan generarse, en un fichero automatizados de datos de carácter personal anteriormente descrito.
Durante el proceso de recogida de datos, y en aquel lugar de la web en el que se soliciten los mismos, el Usuario será convenientemente informado mediante un hipervínculo o mediante la inclusión de la información en el propio formulario, del carácter obligatorio o no de recogida de tales datos para los fines indicados así como de los presentes derechos.
3.2.- Derechos del Usuario: El Usuario podrá ejercitar, respecto de los datos recabados, los derechos reconocidos en la Ley Orgánica 15/1999 de Protección de Datos y en particular los derechos de acceso, oposición, rectificación o cancelación de datos y oposición, así como el de revocación del consentimiento para cualquiera de los usos más arriba descritos.
Los derechos a los que se refiere el párrafo anterior podrán ser ejercitados por el Usuario mediante solicitud dirigida a administrador@jmaznar.es.
4.- Derechos de imagen. Propiedad Industrial e Intelectual. Política de hiperenlaces
4.1.- Todos los contenidos incluidos en la web y en particular, las imágenes, marcas, nombres comerciales, diseños industriales, diseños, textos, fotografías, vídeos, gráficos, logotipos, iconos, software o cualesquiera otros signos susceptibles de utilización industrial y comercial están protegidos por los correspondientes derechos de imagen así como de propiedad industrial e intelectual de Famaztella o de terceros titulares de los mismos que han autorizado su inclusión en la web. Queda por lo tanto prohibida cualquier utilización, y/o reproducción de los mismos sin consentimiento expreso de Famaztella.

4.2.- Famaztella no será responsable de la infracción de los derechos de propiedad intelectual o industrial de terceros que pudieran derivarse de la inclusión en la web de marcas, nombres comerciales, diseños industriales, diseños, textos, fotografías, imágenes, videos, gráficos, logotipos, iconos o software pertenecientes a terceros que hayan declarado ser titulares de los mismos al incluirlos en la web y no consientan su inclusión.
4.3.- En ningún caso se entenderá que el acceso y la navegación del Usuario implica una autorización o que se efectúa renuncia, transmisión, cesión total o parcial de dichos derechos ni la concesión de ningún derecho ni expectativa de derecho y en concreto, de la alteración, transformación, explotación, reproducción, distribución o comunicación pública sobre dichos contenidos sin la previa autorización expresa de Famaztella o de los titulares correspondientes.
4.4.- No se podrá establecer ningún vínculo a la página web desde cualquier otra web sin el consentimiento previo y expreso de Famaztella.
Los enlaces que se establezcan deberán siempre hacerse a la página principal de José María Aznar o en su caso, a aquélla que Famaztella establezca siendo dicho enlace absoluto y completo de forma que le lleve al Usuario al sitio de José María Aznar que deberá abarcar completamente toda la extensión de la pantalla de la página principal.
2.5.- Famaztella no será responsable del contenido de las páginas web de destino que se establezcan mediante vínculos en la web ni tampoco de las infracciones de derechos de terceros en las que dichas páginas pudieran incurrir.
5.- Responsabilidad de Famaztella
El Usuario reconoce y acepta que la utilización de la web y de sus servicios se realiza bajo su entera responsabilidad.
Famaztella únicamente responderá de los daños que el Usuario pueda sufrir como consecuencia de la utilización de la web cuando dichos daños sean imputables a una actuación dolosa de Famaztella.
No obstante, Famaztella declara haber adoptado todas las medidas necesarias, dentro de sus posibilidades y del estado de la tecnología, para garantizar el funcionamiento de la web y evitar la existencia y transmisión de virus y otros componentes que puedan perjudicar al Usuario.
6.-Obligaciones del Usuario
El Usuario se obliga a usar los contenidos de la web de forma diligente, correcta y lícita y se compromete a abstenerse de:
- Utilizar los contenidos con fines o efectos contrarios a la ley, a la moral y a las buenas costumbres o al orden público.
- Reproducir, copiar, distribuir, permitir el acceso del público a través de cualquier modalidad de comunicación pública, transformar o modificar los contenidos, a menos que se cuente con la correspondiente autorización de su titular.
- Utilizar los contenidos de la web para remitir publicidad, comunicaciones con fines de venta directa o con cualquier otra clase de finalidad comercial, mensajes no solicitados dirigidos a una pluralidad de personas con independencia de su finalidad, así como a abstenerse de comercializar o divulgar de cualquier modo dicha información.
7.- Comunicaciones comerciales
Famaztella podrá enviar comunicaciones de contenido publicitario y/o comercial de sus publicaciones y actividades por cualquier medio con pleno respeto a la legislación que en materia de protección de datos personales se encuentre vigente.
Para las comunicaciones comerciales realizadas a través del correo electrónico y medios equivalentes en cumplimiento de lo dispuesto en la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico, será debidamente recabado el consentimiento del Usuario en el momento de recoger los datos correspondientes.
El Usuario podrá revocar en cualquier momento el consentimiento prestado a la recepción de las comunicaciones personales con la simple notificación de su voluntad a administrador@jmaznar.es.
8.- Legislación aplicable
Las relaciones establecidas entre el Usuario y el titular de la web se regirán por lo dispuesto en la normativa vigente acerca de la legislación aplicable y la jurisdicción competente. No obstante, para los casos en los que la normativa prevea la posibilidad a las partes de someterse a un fuero, Famaztella y el Usuario, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, se someten a los Juzgados y Tribunales de Madrid.
En todo caso serán aplicables las normas del Ordenamiento Jurídico Español.

In accordance with the provisions contained in the Personal Data (Protection) Act (Fundamental Law 15 dated December 13th, 1999), Famaztella S.L. informs User(s) of the existence of a personal data file created with the details obtained on the web site by and for Famaztella S.L. under its own responsibility; the said file has been duly notified to the General Register of the Data Protection Agency.
The said file has been created with the purpose of providing information about José María Aznar, as well as the execution of promotional and advertising activities related with the same by any means, including the remission of e-mails, for which your express consent will be requested.
3.1. Consent by Users: Users accept the inclusion of the details obtained during their browsing of the Portal, or provided by the filling-in of any form available on the same as well as those deriving from any possible commercial relationships that may arise, in a computerized personal data file as described above.

4.2. Famaztella will not be responsible for any breach of third-party intellectual or industrial property rights that may derive from the inclusion on the site of trade marks, commercial names, industrial designs, designs, texts, photographs, images, videos, graphic elements, logos, icons or software belonging to third parties who have declared themselves the registered holders of the same on their inclusion on the site and do not consent to their inclusion.
4.3. In no case shall it be understood that access and browsing by Users shall imply any authorization or that they effect any waiver, transfer, total or partial assignment of the said rights or the concession of any right or expectation and, specifically, the alteration, transformation, exploitation, reproduction, distribution or public communication of the said contents without express prior authorization by Famaztella or the corresponding registered holders.
4.4. No link to the web site may be established from any other site without the prior express consent of Famaztella. Any links established must always be to the home page of José María Aznar or, where appropriate, to such page as Famaztella may stipulate; the said links shall be absolute and complete so that they take Users to the web site of José María Aznar, which must completely fill all of the space available on the screen for the home page.
4.5. Famaztella shall not be responsible for the contents of target web pages established by means of on-site links nor for any breaches of third-party rights potentially incurred by the said pages.
5. Liability of Famaztella
Users acknowledge and accept that their use of the site and its services is entirely under their own responsibility.
Famaztella shall only be liable for the damage that may be suffered by Users as a result of the use of the site when such damage is attributable to a wilful action by Famaztella.
Nonetheless, Famaztella declares that it has adopted all necessary measures, within its possibilities and the state of the art, to ensure the proper operation of the site and to prevent the existence and transmission of viruses and other elements that may be harmful to Users.
6. Obligations of Users
Users hereby oblige themselves to use the contents of the site diligently, correctly and legally and they undertake to refrain from:

For commercial communications effected through e‑mail and equivalent systems in accordance with the provisions of the Spanish Information Society and E‑Commerce (Services) Act (Law 34 dated July 11th, 2002), the consent of Users shall be duly obtained at the moment the corresponding details are collected.
Users may revoke the consent given for receipt of personal communications at any time through simple notification of this wish to administrador@jmaznar.es.
8. Applicable legislation
Relationships established between Users and the registered owner of the site shall be governed by the provisions contained in the regulations in force on applicable legislation and competent jurisdiction. Notwithstanding, for those cases in which the regulations provide for the possibility that the parties may submit to a particular venue, Famaztella and the User, with express waiver of any other right of venue that may lie to them, hereby submit to the Courts of the city of Madrid.
In any case, the rules of the Spanish Legal System shall be applicable.
